Freedom for Kay Diesner!

The recent debate over the solidarity t-shirt for Kay Diesner delivers proof that most of those in the Nationalist movement have no idea about the true motives and actions of Kay Diesner.  This is why a correction of the BRD media reports relating to Kay are urgently necessary!  It is, moreover, a paradox that the media is given more belief than a steadfast comrade.  Many comrades even demand the death penalty for Kay Diesner, find that he’s rightfully in prison, and mourn for the “poor victims”.  Such demands and statements are only based on ignorance.

Kay Diesner, who will be 36 years old on June 24th, 2008, finds himself for over 11 years in prison in Lubeck.  He will probably remain behind bars as long as the BRD regime will last.  Right there, he, as some “comrades” demand, has already received the death penalty, namely 3 life sentences!  This punishment can be divided as follows:  one life-sentence for the shooting of Jewish PDS book-keeper, Klaus Baltruschat; one for the fatal injury of a BRD policeman who had opened fire on Kay; and one for a BRD policeman who was left completely untouched, because this policeman abandoned his colleague and ran in fear across the motorway.  Alone, if one ponders the sentence for these deeds, it would be conspicuous to every clear-thinking person that this punitive measure is exaggerated.  You only have to ask yourself some questions.

Now, let’s come to the “poor victims”:  The PDS book salesman Klaus Baltruschat led the constituency office of Gregor Gysi and was at that time already indicated in anti-Antifa lists.  He had with others, encouraged young antifascists to commit violent acts against Nationalists.  In Kay Diesner’s case, this included his mailbox being destroyed several times, the front-door of his house being ignited, his car demolished, glass shards found in his lawn where Kay trained his dog, being heckled and harassed, and bottles being thrown on him from high rise buildings as he passed, including on one occasion, a television set.  So, it is probably clear to everyone that Klaus Baltruschat was in no way an innocent victim.

The BRD policeman Stefan Grage is also being portrayed as an innocent victim, but it must be considered that it was exactly this policeman who incited the shoot-out.  Kay was returning to Berlin when he got a flat tire in the middle of the night.  He drove to the next rest-stop in order to sleep.  The next morning a police van drove by the vehicle and stopped.  Kay’s dog jumped up and as he woke up, the police van continued driving.  He lay back down.  After about 15 minutes the police van returned and requested that Kay leave his car.  Kay had a stolen license-plate, so it was clear to him that the police would discover his personal details.  He took up his weapon and told the police to disarm themselves.  The driver of the police vehicle fled immediately, racing diagonally across the Autobahn motorway.  (For this, Kay received the third life-sentence.)  An elderly married couple intercepted the policeman on the opposite side of the rest area, and calmed him down.  In the meantime, his colleague Stefan Grage opened fire and shot him.  Kay was able to shield himself behind his car.  He shot back, hitting the aggressor in the throat.  He later died of his injuries.  This attack was in no way criminally intended, but rather committed in self-defense.

Whether you consider this a good deed or not, is not important.  The most important thing is that Kay has remained steadfast since this incident.  After 11 years in prison while enduring obvious harassment because of being a nationalist political prisoner, he still didn’t break!  For this reason alone, he should be supported by all possible means.

Therefore we demand freedom for Kay Diesner!

For the last 11 years our berliner comrade Kay Diesner has been locked behind bars in Lübeck. In five years Kay has the possibility to attend his first hearing, where his exact release date will be determined.

We decided to have t-shirts made in support of Kay, and with his blessing, a theme for both men’s t-shirts and girly shirts was determined.

All proceeds from the t-shirts will be deposited into a special account.  The money will then be presented to him on a later date.  Kay would like to use the money for a lawyer, who he will need to represent him at his hearing in five years time.  If he is in need of support before that, we would of course oblige.

Here is a report from one of Kay’s comrades who spent a considerable time behind bars with him at JVA-Lubeck:

Kay Diesner (by Mario Hammer)

On April 6th, 2004, I had the dubious pleasure of beginning my several-year sentence at the Lubeck Prison (JVA-Lübeck).  Why I was there isn’t important, because I would like to report on probably the most well-known political prisonner that the BRD (Federal Republic of Germany) has held for over 11 years.

The purpose of this report is not to give an explanation of the reasons why he is in custody and his actual deeds, but rather it is about the person himself and his current prison-conditions.  So much about the official version of the story about this comrade should be questioned.  Many of the facts of the case were manipulated, distorted, and swept under the rug.  In my eyes, these were  typical methods of an occupied Justice System to criminalize and lock away persons with political views they deem to be unpleasant.  This concerns mainly people with Nationalist sentiments.  There’s so much about this!

After the first few weeks in custody, I got the opportunity to meet Kay Diesner.  We got along immediately and took every opportunity to see each other and exchange ideas, like in the alotted free-time, free-hour or at other information sessions.  Once you‘ve earned your trust with him, Kay is a very open and honest person!  He is a through-and-through comrade and has not lost his belief in a Free Nationalist Germany, even after all the years in prison.  On the contrary, Kay accepts his fate and reckons that he will probably never again be a free man.  Nobody can blame him that his life-long sentence is carried with an especially heavy burden.  Despite the hopelessness of an end to the torment, Kay remains unbowed and in his prison cell he hopes for massive change for the good of the Folk and Fatherland.

It wasn’t long before the direction of the institution paid heed, because it was obviously a thorn in their side that Kay, after many years in custody, had met someone inside the prison walls that he got along so well with.  I was called to the office of the Director and there it was made clear to me that the friendship with Kay was regarded as, in the eyes of the direction, a „danger to the security of the establishment“.  So they acted quickly and I was transferred to another section (house) of the prison.  Yet they still couldn’t break contact with Kay and I.  We still met during free-time activities like football or chess and we were still in contact through the in-house mail.

I feel for Kay even today, because even as a long-term prisonner he is waiting in an admission wing, (Note:  Since January 2008, he is now finally in the long-term wing of the prison.  After 11 years!!!)  and because of it doesn’t have the privaledges of a regular long-term prisoner.  That would mean for example, longer times let out of his cell and a better cell arrangement.

The prison staff were always anxious to surround kay with immigrants.  The cells to the left and right of Kays as well as above and below were occupied by foreigners.  So Kay had to listen to foreign music (horrible racket) from morning to night (Kay named this music also "Wüstentuntenmusik" - tunes from the desert) and endure the constant aggressive conversations at the cell windows about himself.  This is pure terror for most Germans, let alone Nationalists!

For every prisoner within the prison, it is important to keep his social contacts on the outside.  This happens by mail, telephone or visits from family and friends.  Especially long-term prisoners are encouraged to maintain these contacts.  In detention, it is common that a prisoner awaiting trial may not use the telephone, and that his mail is being controlled and read.  This changes normally for every prisoner, when he is sentenced.  Then the telephone is allowed and the mail can only be surveyed for forbidden symbols and objects.  That doesn’t apply to Kay Diesner!

It is generally well-known that the telephones inside the prison are being monitored, like many others in the oh-so-free B-R-D.  Now, Kay was supposed to have said something many years ago on the telephone that rubbed the direction the wrong way.  A telephone ban was imposed on Kay that had begun about 7 years ago, and is still in effect today!  So, Kay is the only sentenced prisoner in Lubeck Prison who may not use the telephone!  His mail is still being read and controlled after a decade in custody.

Woe is Kay, if there is something that doesn’t fit the institute direction!  Reprisals like lock-in and contact-bans follow immediately.  Kays cell is constantly searched, almost weekly.  Cell searches are almost normal in a prison, yet that Kay’s cell is so often thoroughly searched breaks the barriers of the norm by far.  During these searches, they remove objects from Kay’s cell that were tolerated before by the prison direction.  For example, they took away Kay’s entire book-collection, although it had been legally obtained.  This also concerns music.  Legally ordered CD’s are being collected without reason by the prison guards.  The main task of a judicial penal institution is to rehabilitate the prisoners from the first day of their custody.  Whether this applies to Kay Diesner is more than only questionable.  He is not being treated like a usual prisoner!

Whether Kay at some point has the pleasure of being let out of prison, be it for execution, release from prison, or temporary release, it is to be decided by five different government bodies:  1.  Department of Justice,  2.  District Court,  3.  District Attorney’s Office (Public Prosecutor),  4.  Court Expert, and 5.  The Institute Direction (Prison Direction).

The answer explains itself.

I hope, that Kay continues to be brave and receives the needed support from family and friends, like he deserves and needs!
